Terms of Service

By creating an account or using EvidenceKeeper™ ("the Service"), you agree to these Terms. If you do not agree, please do not use the Service.

EvidenceKeeper is a tool to help you document observable facts, preserve evidence, and generate organized reports. It is not a law firm and does not provide legal advice. Always consult a qualified attorney for legal matters.

Justice™ is an AI documentation assistant. AI-assisted output (extractions, summaries, classifications, pattern observations) may contain errors and is clearly labeled as AI-generated. AI output never replaces your original evidence, and you should review it and have qualified counsel review it before relying on it. EvidenceKeeper extracts, organizes, classifies, calculates, compares, and identifies documented occurrences and gaps — it does not determine guilt, fault, credibility, admissibility, or legal strategy, and it cannot tell you whether you will win or lose.

You are responsible for keeping your password and Vault PIN confidential and for all activity under your account. Provide accurate information and notify us of any unauthorized use.

You retain full ownership of everything you upload. You are responsible for ensuring you have the right to record and store the material you add, and for complying with the laws that apply to you.

Paid plans (Standard Protection — $24.99/month and Litigator Pro — $44.99/month) are billed on a recurring basis and include a 7-day free trial. Web subscriptions are processed by Stripe; purchases made in a mobile app store are processed by that store and are subject to the store's terms. You are never charged without confirming the purchase. A free trial only converts to a paid subscription after your explicit authorization; simply tapping a premium feature does not charge you. You may cancel anytime and retain access until the end of the current paid period. The Case Prep Pass™ ($89, one-time) unlocks full Litigator Pro features for a single case and is not a subscription.

AI features consume KeeperCredits. Each plan includes a monthly allowance (Basic Watch 20 · Standard Protection 150 · Litigator Pro 1,000). Subscription KeeperCredits reset on your billing anniversary and do not roll over. You may also purchase additional KeeperCredits (100 for $9.99); purchased KeeperCredits never expire and are only spent after your monthly allowance is used. Estimated credit cost is shown before a significant AI operation, and reopening an already-generated analysis does not consume credits again. Manual logging, search, and export remain free.

Do not use the Service to store unlawful content or to harass, defraud, or harm others. Do not attempt to breach security, access other users' data, or scrape credentials from third-party services. We may suspend accounts that violate these Terms or applicable law.

The Service is provided "as is" without warranties of any kind. EvidenceKeeper does not guarantee legal admissibility, chain of custody, or any particular outcome. To the fullest extent permitted by law, Herrell Interactive / Herrell Homestead LLC is not liable for indirect, incidental, or consequential damages arising from your use of the Service, and total liability is limited to the amount you paid in the prior 12 months. You are responsible for maintaining your own backups of critical records.

We may update these Terms from time to time. Continued use after changes take effect constitutes acceptance of the revised Terms. Questions? Contact support@herrellinteractive.com.
